Summary of Changes from Previous Version
- additional sections to ensure that a trauma informed approach is being adopted for students who have experienced trauma, and who are now assisting the University in a misconduct matter.
- additional information on the decision-making process to assist decision makers on the options available to them when first considering matters of student misconduct.
- addition of clauses to clarify key issues such as the burden of proof, balance of probabilities and the Briginshaw test, to further assist decision makers.
- Addition of clauses to further clarify the roles of witnesses and advocates.
- the definition of what constitutes extenuating circumstances have been re-drafted, to allow greater flexibility of decision makers when determining whether special consideration should be applied to a matter that has a prescribed minimum sanction.
- Addition of a section on Research Misconduct to clarify the processes leading up to the formal referral of Research Misconduct under the Rule.
