The University is a public sector agency for the purposes of the Public Interest Disclosures Act 1994 (NSW) and, as such, is required to have in place a policy and procedures to receive and manage reports of alleged corruption, maladministration and the like. The name of these procedures align with the renaming of the associated policy. The new name will also make the policy and associated procedures easier to locate in the A-Z of the Policy DDS. The policy and procedures, which are aligned with Securing Success 2018-2020, are now in separate documents and are in plain English and the active voice. The policy and procedures recognise that reports of corruption or wrongdoing can be made by people other than public officials (in particular, students and members of the public). While those reports may not attract protection under the Act (this is because the Act only provides protection to reporters who are “public officials”, that is, officers and employees), the policy and procedures acknowledge that these reports will be managed in the same way and that, as far as possible, the University will afford similar protection to that available to public officials under the Act. Other changes reflected in the revised associated policy are: 1. the Director, Audit & Risk Assessment is now included as a Disclosures Officer; 2. roles and responsibilities in the policy and procedures are more clearly defined and assigned; 3. mandatory risk assessment is now required for all reports, to identify and assess risk of reprisals; 4. there is now a clear link to the misconduct investigation procedures in the University’s staff agreements when the alleged wrongdoer is a member of staff; 5. there is a clear link back to the Disclosures Coordinator at the conclusion of any matter previously referred for investigation under the University’s staff agreement; and 6. there is a clear link to other relevant procedures for matters that are not appropriate to investigate under this policy, but which otherwise require investigation.
